MyRentable Terms of Service

These Terms govern access to and use of the MyRentable marketplace, including accounts, listings, bookings, payments, owner payouts, damage claims, communications, and disputes.

Quick summary

1. Agreement to These Terms

These Terms of Service constitute a binding agreement between you and MyRentable, LLC. They govern your access to and use of the MyRentable website, applications, technology, content, communications, payment features, and marketplace services.

By creating an account, checking an acceptance box, listing property, requesting or completing a booking, making or receiving a payment, or otherwise using MyRentable, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you may not create an account or use the MyRentable platform.

2. Definitions

Account
A registered MyRentable user profile used to access marketplace services.
Booking
A requested, accepted, confirmed, modified, completed, cancelled, rejected, or refunded rental transaction arranged through MyRentable.
Content
Text, photographs, images, messages, reviews, documents, listing information, and other material submitted to or displayed through MyRentable.
Damage
Physical loss, breakage, destruction, excessive cleaning, missing components, theft, misuse, or other deterioration beyond ordinary wear and tear.
Deposit
An amount authorized, collected, held, or reserved in connection with a Booking to address potential payment obligations, Damage, loss, late return, or other permitted charges.
Listing
An offer created by an Owner describing property available for rent through MyRentable.
Marketplace
The technology and services provided by MyRentable that enable users to publish Listings, communicate, arrange Bookings, make payments, and participate in related workflows.
Owner
A user who offers or provides property for rent through MyRentable.
Rental Period
The confirmed start and end dates or times during which a Renter is authorized to possess or use rented property.
Renter
A user who requests, books, receives, possesses, transports, or uses property rented through MyRentable.
Service Fee
A fee charged by MyRentable for providing marketplace, technology, support, transaction, and related services.
User
Any person or organization accessing or using MyRentable, including an Owner, Renter, or a person acting in both roles.

3. Eligibility

You must be at least eighteen years old and legally capable of entering into binding contracts to create an Account or complete a Booking.

You may not use MyRentable if you are legally prohibited from using the services, have previously been permanently removed from the platform, or are acting for an unlawful or fraudulent purpose.

When using MyRentable for a business, organization, employer, partnership, or other entity, you represent that you have authority to bind that entity to these Terms.

Certain Listings may require additional qualifications, licenses, training, permits, insurance, age requirements, or verification. Users are responsible for determining and satisfying all requirements applicable to a particular rental.

4. Accounts and Registration

You must provide accurate, current, and complete registration information and keep your Account information updated.

  • Maintain the confidentiality of your password and authentication credentials.
  • Do not share your Account or allow another person to impersonate you.
  • Notify MyRentable promptly of suspected unauthorized access.
  • Do not create duplicate, misleading, fraudulent, or evasive Accounts.
  • Do not use another person's identity or submit false verification information.

You are responsible for activity performed through your Account unless applicable law requires otherwise.

MyRentable may require email confirmation, identity verification, payment verification, tax information, additional documentation, or other checks before allowing access to particular features.

5. MyRentable’s Marketplace Role

MyRentable provides technology that enables Owners and Renters to find one another, communicate, arrange rentals, make payments, document transactions, submit reviews, and use related marketplace services.

  • MyRentable is not the Owner of property listed by Users.
  • MyRentable is not the Renter of property booked by Users.
  • MyRentable generally does not take possession of listed property.
  • MyRentable is not the manufacturer, seller, installer, maintainer, or repairer of listed property.
  • MyRentable is not an employer, agent, partner, joint venturer, broker, or representative of any User.
  • MyRentable does not guarantee the condition, legality, safety, quality, suitability, availability, or performance of any Listing.

A rental relationship is formed directly between the applicable Owner and Renter when a Booking is confirmed. Each party is independently responsible for performing their obligations.

MyRentable may provide assistance, documentation tools, payment processing, claim review, support, or dispute-facilitation services without becoming a party responsible for the underlying property or rental conduct.

6. Owner Responsibilities

An Owner must have lawful ownership, possession, authority, and any required permission to list and rent the property.

  • Provide truthful, complete, and current descriptions, photographs, prices, availability, dimensions, specifications, limitations, and condition information.
  • Disclose known defects, hazards, damage, recalls, missing components, special operating requirements, and material limitations.
  • Ensure the property is reasonably safe, functional, clean, maintained, and suitable for the permitted rental purpose.
  • Provide required manuals, instructions, warnings, protective equipment, accessories, keys, attachments, and safety information.
  • Comply with applicable licensing, inspection, registration, insurance, tax, transportation, storage, and safety requirements.
  • Honor confirmed Bookings unless cancellation is permitted by applicable policy.
  • Deliver or make the property available at the agreed location and time.
  • Communicate promptly and professionally with Renters.
  • Accurately document the property's pre-rental and post-rental condition.
  • Avoid discriminatory, deceptive, abusive, or retaliatory conduct.

Owners may not require a Renter to waive rights that cannot lawfully be waived or impose undisclosed charges or terms after a Booking has been confirmed.

Owners remain responsible for determining whether their personal, commercial, property, vehicle, equipment, or other insurance covers marketplace rentals.

7. Renter Responsibilities

A Renter must use, possess, transport, store, and return rented property responsibly, lawfully, and in accordance with the Listing, Owner instructions, manufacturer guidance, and applicable law.

  • Inspect the property at pickup or delivery and promptly report material discrepancies or unsafe conditions.
  • Use the property only for lawful and disclosed purposes.
  • Follow operating instructions, warnings, restrictions, and safety procedures.
  • Do not allow unauthorized, unqualified, unlicensed, impaired, or underage persons to use the property.
  • Do not sell, subrent, pledge, alter, modify, repair, dismantle, or dispose of the property without written authorization.
  • Protect the property from theft, weather, misuse, loss, contamination, and avoidable Damage.
  • Return the property on time, clean, complete, and in substantially the same condition, ordinary wear and tear excepted.
  • Return all accessories, attachments, keys, manuals, chargers, batteries, and related components.
  • Promptly report accidents, theft, Damage, malfunction, law-enforcement contact, or other material incidents.
  • Pay all charges properly incurred under the Booking and applicable policies.

The Renter may be responsible for Damage, loss, theft, late-return costs, extraordinary cleaning, missing items, towing, recovery, storage, fines, penalties, and other amounts resulting from the Renter's possession or use, subject to applicable law and MyRentable policies.

8. Listings

Listings must be accurate, lawful, non-deceptive, and sufficiently detailed for a reasonable Renter to understand the property, price, availability, condition, permitted use, restrictions, and pickup or delivery requirements.

  • Listings may not offer prohibited, stolen, counterfeit, recalled, unsafe, illegal, or unlawfully possessed property.
  • Photographs must reasonably represent the actual property being offered.
  • Owners may not publish duplicate or misleading Listings intended to manipulate search results.
  • Listing prices, deposits, included accessories, and material charges must be disclosed before confirmation.
  • Owners must keep availability information reasonably current.

MyRentable may review, restrict, correct, remove, suspend, or refuse a Listing when reasonably necessary to enforce these Terms, protect Users, comply with law, prevent fraud, or address safety concerns.

9. Bookings and Rental Periods

A Booking is not confirmed until the platform identifies it as confirmed and any required payment authorization or payment has been successfully completed.

Booking requests may be accepted, rejected, cancelled, modified, or allowed to expire according to the applicable workflow and Marketplace Policies.

The confirmed Rental Period determines when the Renter is authorized to possess or use the property. Extensions or other material changes must be approved and processed through MyRentable.

Users may not avoid MyRentable fees, protections, records, or payment systems by moving a transaction off-platform after meeting through MyRentable.

Pickup, delivery, inspection, identity confirmation, transfer of possession, and return arrangements are the responsibility of the applicable Owner and Renter unless MyRentable expressly provides otherwise.

10. Fees and Payments

Users authorize MyRentable and its payment processors to collect, authorize, hold, transfer, refund, reverse, or otherwise process amounts associated with Bookings, Service Fees, deposits, claims, taxes, chargebacks, adjustments, and other permitted charges.

The Renter-facing MyRentable Service Fee is calculated from the rental subtotal according to the fee schedule displayed during checkout and described in the Platform Fees & Payment Policy.

  • A minimum $3 Service Fee applies to rental subtotals under $50.
  • A 7% Service Fee applies to rental subtotals from $50 through $249.99.
  • A 6% Service Fee applies to rental subtotals from $250 through $999.99.
  • A 5% Service Fee applies to rental subtotals from $1,000 through $2,499.99.
  • A 4% Service Fee applies to rental subtotals of $2,500 or more.

The complete amount due will be displayed before payment. Additional charges may apply only when authorized by these Terms, a disclosed Listing term, a confirmed modification, an applicable policy, or law.

A User may not submit an improper chargeback, payment reversal, or payment dispute to avoid a valid obligation. MyRentable may suspend affected transactions, payouts, or Accounts while investigating payment disputes.

11. Security Deposits and Payment Authorizations

A Booking may require a security deposit, payment authorization, card hold, reserve, or other payment assurance.

A Deposit is not necessarily an estimate or limitation of a Renter's potential responsibility. Where permitted by law, responsibility may exceed the Deposit when substantiated Damage, loss, late-return costs, or other authorized amounts exceed it.

Unused Deposit amounts or authorizations will be released or refunded according to the applicable payment method, processor timing, Booking status, and any unresolved claim.

12. Owner Payouts

Eligible Owner earnings may be released after the applicable Rental Period and any required review, hold, reserve, verification, refund, dispute, or claim period.

MyRentable may delay, reduce, reverse, offset, or withhold a payout when reasonably necessary to address fraud, chargebacks, refunds, duplicate payments, legal process, policy violations, incorrect payment information, negative balances, or other legitimate transaction concerns.

Owners must maintain accurate payment and tax information and cooperate with payment-processor verification requirements.

13. Cancellations, Modifications, and Refunds

Cancellation, modification, no-show, and refund eligibility is determined by the Booking status, timing, reason, applicable Listing terms, payment status, platform records, and the Cancellation & Refund Policy.

Users must submit cancellation and modification requests through the platform when the required workflow is available.

MyRentable may issue full, partial, or no refund depending on the applicable policy and verified circumstances. Payment-processor timelines may affect when funds become available after a refund is issued.

Repeated, abusive, fraudulent, or bad-faith cancellations may result in restrictions or Account action.

14. Damage, Loss, and Claims

Owners and Renters must inspect property and preserve clear pre-rental and post-rental evidence whenever reasonably possible.

A claim should be submitted promptly through the applicable MyRentable workflow and must include truthful, relevant, and reasonably available evidence.

  • Photographs or video showing the property's condition.
  • Descriptions of the event and when it occurred.
  • Messages or communications relevant to the claim.
  • Receipts, estimates, invoices, or evidence of value.
  • Police reports, incident reports, or insurance information when applicable.
  • Information requested by MyRentable during review.

MyRentable may approve, partially approve, deny, resolve, or close a claim based on the available evidence and applicable policies. MyRentable may also coordinate with payment processors, insurers, repair providers, law enforcement, or other appropriate parties.

Ordinary wear and tear is generally not chargeable Damage. Betterment, unsupported replacement demands, pre-existing Damage, and speculative loss may be reduced or denied.

15. Insurance and Protection Products

Unless expressly stated in a separate written policy, certificate, or coverage document, MyRentable is not an insurer and does not guarantee that any loss will be covered.

Owners and Renters are responsible for reviewing their own insurance policies and determining whether marketplace rentals, commercial use, transportation, theft, liability, or Damage are covered.

Until MyRentable expressly identifies a licensed third-party insurer and provides separate coverage documents, any optional protection offered by MyRentable is a platform benefit rather than insurance. It may reduce a User's financial responsibility only for eligible accidental Damage approved after individual review and remains subject to eligibility rules, exclusions, reporting deadlines, documentation requirements, and applicable limits. Purchase does not guarantee approval or reimbursement.

16. Identity and Account Verification

MyRentable may require Users to verify identity, age, contact details, payment information, ownership, business authority, licenses, or other relevant qualifications.

Users must provide truthful, authentic, current, and unaltered information. False, stolen, manipulated, or misleading documents are prohibited.

Verification does not guarantee that a User is trustworthy, qualified, safe, or free from prior misconduct. Users must exercise reasonable judgment when participating in a rental.

MyRentable may restrict access while verification is pending or when information cannot be verified.

17. Messaging and Communications

Users must communicate honestly, professionally, and for legitimate marketplace purposes.

  • Harassment, threats, hate, intimidation, extortion, stalking, and abusive communication are prohibited.
  • Spam, phishing, malicious links, impersonation, and deceptive payment requests are prohibited.
  • Users may not use messages to evade fees or move a MyRentable-originated transaction off-platform.
  • Users may not share information when doing so would violate law, privacy rights, or another person's safety.

MyRentable may store, review, preserve, or disclose communications when permitted by law and reasonably necessary for support, safety, fraud prevention, policy enforcement, dispute review, or legal compliance.

18. Reviews and Marketplace Content

Reviews must reflect genuine marketplace experiences and must not be fraudulent, retaliatory, extortionate, discriminatory, irrelevant, or manipulated.

Users may not offer compensation for a particular review outcome, coordinate fake reviews, review their own Accounts, or threaten a negative review to obtain money, refunds, or benefits.

MyRentable may remove, restrict, or decline to publish Content that violates these Terms, applicable policy, law, privacy rights, or marketplace integrity.

19. Prohibited Conduct

  • Fraud, theft, deception, scams, identity theft, money laundering, or payment abuse.
  • Listing or renting prohibited, stolen, counterfeit, unsafe, recalled, or illegal property.
  • Circumventing Service Fees, payments, safety systems, claim procedures, or platform records.
  • Creating false Accounts, manipulating verification, or impersonating another person.
  • Harassment, discrimination, threats, violence, retaliation, or exploitation.
  • Uploading malware, scraping without authorization, interfering with security, or attempting unauthorized access.
  • Using MyRentable for unlawful activity or in violation of licenses, permits, sanctions, export restrictions, or other legal requirements.
  • Submitting false reports, fabricated evidence, fraudulent claims, or knowingly inaccurate information.
  • Manipulating search results, reviews, availability, prices, referrals, promotions, or marketplace metrics.

Additional restrictions are described in the Community Standards and Prohibited Items Policy.

20. Safety and Incident Reporting

Users are responsible for evaluating property, instructions, locations, counterparties, transportation, and rental circumstances before proceeding.

In an emergency or when immediate danger exists, contact emergency services before contacting MyRentable.

Users should promptly report unsafe Listings, credible threats, theft, fraud, recalls, serious incidents, or suspected violations through available reporting channels.

MyRentable may take precautionary action, including restricting Listings, pausing payments, preserving information, or suspending Accounts while a safety matter is reviewed.

21. Taxes and Regulatory Compliance

Users are responsible for understanding and complying with tax, licensing, reporting, registration, consumer-protection, zoning, transportation, safety, and other requirements applicable to their marketplace activity.

MyRentable may collect, report, remit, withhold, or provide tax information when required by law or when supported by platform functionality.

Owners are responsible for income-tax obligations and for maintaining records necessary to support their tax reporting.

MyRentable does not provide legal, accounting, insurance, or tax advice.

22. Intellectual Property and User Content

MyRentable and its licensors own the platform software, design, branding, trademarks, logos, databases, and other proprietary material, excluding User Content.

Users retain ownership of Content they create, subject to the rights necessary for MyRentable to operate, improve, secure, promote, and provide the marketplace.

By submitting Content, you grant MyRentable a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, format, display, distribute, and use that Content for platform-related purposes, subject to the Privacy Policy and applicable law.

You represent that you have the rights necessary to submit the Content and that its use does not infringe intellectual-property, privacy, publicity, contractual, or other rights.

23. Third-Party Services

MyRentable may rely on third-party providers for payment processing, identity verification, email, hosting, storage, analytics, fraud prevention, insurance, mapping, or other services.

Third-party services may be governed by separate terms and privacy practices. MyRentable is not responsible for a third party's independent acts or omissions except where applicable law requires otherwise.

24. Disclaimers

MyRentable does not warrant that the platform will be uninterrupted, error-free, secure, or available at all times.

MyRentable does not guarantee a User's identity, conduct, qualifications, financial condition, reliability, or compliance with law.

MyRentable does not independently guarantee the accuracy, condition, safety, legality, suitability, availability, value, fitness, performance, or quality of any Listing.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.

25. Limitation of Liability

To the fullest extent permitted by law, MyRentable and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost data, lost opportunity, business interruption, or reputational harm arising from or related to use of the marketplace.

MyRentable is not responsible for injury, death, property Damage, theft, loss, defects, unsafe conditions, unlawful conduct, missed opportunities, transportation issues, or disputes caused by Users, Listings, rented property, or third parties, except to the extent liability cannot lawfully be limited.

To the fullest extent permitted by law, MyRentable's aggregate liability arising from a particular Booking or event will not exceed the greater of the Service Fees paid to MyRentable for that Booking or one hundred dollars, unless applicable law requires a different amount.

These limitations apply only to the extent permitted by applicable law and do not limit liability that cannot legally be limited.

26. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless MyRentable and its officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable legal fees arising from or relating to:

  • Your Listing, Booking, rental, possession, transportation, storage, or use of property.
  • Your Content, communications, conduct, negligence, or intentional misconduct.
  • Your violation of these Terms, incorporated policies, or applicable law.
  • Your infringement of another person's rights.
  • Taxes, permits, licenses, insurance, fines, or regulatory obligations for which you are responsible.
  • Damage, injury, death, theft, loss, or other harm caused by you or property under your control.

This section does not require indemnification for claims caused solely by MyRentable's conduct to the extent such indemnification would be prohibited by law.

27. Dispute Resolution and Governing Law

Before filing a legal claim against MyRentable, you agree to contact MyRentable and provide a reasonable opportunity to attempt informal resolution.

Users involved in a marketplace dispute must cooperate reasonably with applicable support, payment, refund, claim, evidence, and appeal procedures.

Except where consumer-protection law requires otherwise, these Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules.

Unless the parties agree to another permitted process, legal proceedings involving MyRentable must be brought in a court with proper jurisdiction serving Douglas County, Wisconsin, except where applicable law permits or requires a different forum.

Nothing in these Terms prevents a party from seeking eligible relief in small-claims court or requesting emergency injunctive relief where legally appropriate.

28. Suspension and Termination

MyRentable may warn, restrict, suspend, deactivate, or terminate an Account or Listing when reasonably necessary to enforce these Terms, protect the marketplace, investigate conduct, comply with law, prevent fraud, address safety concerns, or manage payment risk.

  • Fraud, theft, payment abuse, chargeback abuse, or attempted circumvention.
  • False identity information or manipulated verification documents.
  • Unsafe, unlawful, discriminatory, threatening, or abusive conduct.
  • Repeated cancellations, no-shows, unresolved negative balances, or serious performance failures.
  • Prohibited Listings, counterfeit goods, stolen property, or intellectual-property violations.
  • Failure to cooperate with a legitimate investigation, claim, legal process, or safety review.

Suspension or termination does not eliminate payment, return, claim, tax, indemnification, dispute, or other obligations arising before the action.

An appeal may be available according to the Community Standards and applicable Trust and Safety procedures.

29. Privacy

MyRentable's collection, use, retention, protection, and disclosure of personal information is described in the Privacy Policy.

By using the platform, you acknowledge that information may be processed as necessary to provide marketplace services, prevent fraud, support transactions, enforce policies, comply with law, and protect Users.

Information about cookies and similar technologies is described in the Cookie Notice.

30. Changes to These Terms

MyRentable may update these Terms to reflect changes in law, platform features, business practices, risk controls, payment systems, insurance products, or marketplace operations.

The current version, effective date, and last-updated date will be displayed in the Legal Center.

When a change is material, MyRentable may provide notice and may require acceptance of the updated Terms before continued use of some or all platform features.

Changes will not retroactively alter completed transactions unless required by law or expressly agreed by the affected parties.

32. General Terms

These Terms, together with incorporated policies and transaction-specific information, form the agreement governing use of MyRentable.

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

MyRentable's failure to enforce a provision is not a waiver of its right to enforce that provision later.

You may not assign your rights or obligations under these Terms without written permission from MyRentable. MyRentable may assign its rights and obligations in connection with a merger, financing, reorganization, sale, transfer, or other lawful business transaction.

Headings are provided for convenience and do not limit the meaning of a provision.
