MyRentable Damage Claims Policy

This Policy explains responsibility for damage, loss, theft, missing items, excessive cleaning, evidence requirements, claim deadlines, repair costs, replacement value, deposits, decisions, payments, and appeals.

1. Purpose and Scope

This Damage Claims Policy explains how MyRentable, LLC reviews claims involving rented property, including physical damage, theft, loss, missing components, excessive cleaning, unauthorized alteration, late return, and related financial loss.

This Policy applies to Owners and Renters participating in Bookings processed through MyRentable.

This Policy supplements the Terms of Service, Community Standards, Cancellation and Refund Policy, Platform Fees and Payment Policy, Owner Payout Policy, and any applicable protection or insurance documents.

This Policy establishes MyRentable's marketplace claim process. It does not determine every legal right, insurance obligation, or remedy that may exist outside the platform.

2. Core Claim Principles

  • The Owner must prove that an eligible loss occurred and that the amount requested is reasonable.
  • The Renter must cooperate honestly and provide relevant information concerning the property's possession, use, condition, and return.
  • Pre-rental and post-rental condition evidence is strongly preferred.
  • A security Deposit is not automatic payment to the Owner and does not prove responsibility.
  • A claim may be approved only for the supported amount of eligible loss.
  • MyRentable may reduce a claim for pre-existing damage, ordinary wear, depreciation, betterment, salvage value, inadequate maintenance, or unsupported costs.
  • Claim decisions may be made from the available evidence when a User does not respond within a reasonable period.
  • Nothing in this Policy eliminates rights or remedies that cannot lawfully be waived.

3. Definitions

Actual Cash Value
The reasonable value of property immediately before the covered loss, considering age, condition, prior damage, useful life, market value, and depreciation.
Betterment
An improvement that leaves property in materially better condition or with greater value, quality, capacity, or useful life than immediately before the Booking.
Claim
A request submitted through MyRentable seeking payment, reimbursement, recovery, or another remedy for an alleged rental-related loss.
Claimant
The Owner or other authorized person submitting a Claim.
Damage
Physical breakage, destruction, impairment, contamination, unauthorized alteration, or other deterioration beyond ordinary wear and tear.
Excessive Cleaning
Cleaning reasonably required because the property was returned in a condition materially worse than expected from proper use, excluding routine turnover cleaning.
Loss
Theft, disappearance, destruction, nonreturn, missing components, or another supported deprivation of property or value.
Ordinary Wear and Tear
Deterioration that reasonably occurs through normal, careful, and permitted use during the Rental Period.
Pre-Existing Damage
Damage, wear, defect, contamination, missing property, or impaired condition that existed before the Renter received possession.
Replacement Cost
The reasonable cost to replace property with an item of comparable type, age, condition, quality, and functionality when repair is not reasonable.
Respondent
The User against whom a Claim is submitted.
Security Deposit
An amount authorized, collected, held, or reserved in connection with a Booking to address potential payment obligations.

4. Owner Pre-Rental Documentation

Owners should create clear, date-relevant records of the property's condition before each rental.

  • Photographs or video showing all sides and material surfaces.
  • Close-up photographs of existing scratches, dents, cracks, stains, repairs, and other wear.
  • Photographs of serial numbers, identification marks, mileage, hours, fuel level, battery level, or other relevant measurements.
  • A list of included keys, chargers, batteries, controls, manuals, attachments, safety equipment, and accessories.
  • Documentation showing that material functions and safety systems operated before transfer.
  • Disclosure of known defects, limitations, prior damage, recalls, and maintenance concerns.

Documentation should reasonably identify the actual property involved in the Booking and should be created close enough to transfer to reflect its pre-rental condition accurately.

A lack of reliable pre-rental evidence may prevent MyRentable from determining whether claimed Damage occurred during the Booking.

5. Renter Pickup and Delivery Documentation

Renters should inspect and document property before accepting or using it.

  • Compare the property with the Listing description and photographs.
  • Photograph visible damage, missing components, excessive dirt, warning indicators, and unusual conditions.
  • Confirm included accessories, attachments, keys, chargers, controls, and safety equipment.
  • Record relevant mileage, operating hours, fuel level, battery level, or other measurements.
  • Report material discrepancies or safety concerns through MyRentable promptly.
  • Do not use property that appears unreasonably unsafe or materially different from the confirmed Listing.

Failure to report an obvious pre-existing condition promptly may make the condition more difficult to verify, but it does not automatically establish Renter responsibility.

6. Renter Responsibility

Subject to available evidence, Listing terms, applicable law, and this Policy, a Renter may be responsible for loss occurring while the property is in the Renter's possession or control.

  • Damage caused by misuse, negligence, abuse, improper operation, or prohibited use.
  • Damage caused by an unauthorized, unqualified, unlicensed, underage, or impaired user.
  • Damage caused by exceeding disclosed capacity, weight, speed, operating, geographic, or environmental limits.
  • Theft, disappearance, abandonment, or nonreturn.
  • Missing accessories, keys, controls, attachments, chargers, batteries, manuals, or components.
  • Unauthorized modifications, repairs, disassembly, programming, painting, or alteration.
  • Damage caused by inadequate storage, transportation, security, weather protection, fueling, charging, or maintenance during the Rental Period.
  • Excessive Cleaning caused by improper use, contamination, smoke, animals, chemicals, waste, mud, grease, bodily fluids, or other unusual conditions.
  • Reasonable recovery, towing, storage, inspection, or transport costs directly resulting from an eligible incident.

7. Owner Responsibility

An Owner remains responsible for losses arising from the Owner's property condition, instructions, maintenance, conduct, or failure to disclose material information.

  • Pre-Existing Damage.
  • Ordinary Wear and Tear.
  • Mechanical failure not caused by the Renter.
  • Damage caused by inadequate maintenance, defective parts, improper repairs, or unresolved recalls.
  • Damage caused by inaccurate instructions or failure to disclose material operating requirements.
  • Loss resulting from an Owner's failure to provide required keys, controls, safety equipment, attachments, or documentation.
  • Routine cleaning and normal turnover costs.
  • Loss resulting from the Owner's unlawful, unsafe, deceptive, or materially inaccurate Listing.
  • Betterment, upgrades, preventive maintenance, and unrelated repairs.

8. Ordinary Wear and Tear

Ordinary Wear and Tear is not eligible Damage.

Examples may include:

  • Minor surface wear consistent with proper use.
  • Normal tire, blade, belt, chain, brake, bearing, battery, or consumable wear.
  • Reasonable dust or dirt associated with the disclosed rental purpose.
  • Minor cosmetic marks that do not impair value or function materially.
  • Expected fuel, lubrication, charge, or consumable use.
  • Age-related deterioration not caused by a specific rental event.
  • Failure of a component that reached the end of its ordinary useful life.

The distinction between eligible Damage and Ordinary Wear and Tear depends on the property type, age, prior condition, rental duration, disclosed use, operating conditions, maintenance history, and available evidence.

9. Pre-Existing Damage

A Renter is not responsible for Damage or defects that existed before possession unless the Renter later worsened the condition through misuse, negligence, or failure to take reasonable protective action.

MyRentable may compare:

  • Listing photographs.
  • Owner pre-rental photographs and video.
  • Renter pickup or delivery photographs and video.
  • Prior Booking and Claim records.
  • Maintenance, repair, inspection, and purchase records.
  • Messages disclosing existing wear, defects, or limitations.
  • Metadata, timestamps, and other available authenticity indicators.

10. Mechanical and Electrical Failure

A mechanical, electrical, electronic, hydraulic, structural, software, battery, or other component failure is not automatically Renter-caused Damage.

MyRentable may consider:

  • The property's age, condition, hours, mileage, and maintenance history.
  • Whether the Owner disclosed prior symptoms or limitations.
  • Whether the property was used within disclosed requirements.
  • Warnings, fault codes, operating data, photographs, or diagnostic records.
  • Whether continued operation after a warning worsened the condition.
  • Whether misuse, overload, impact, contamination, incorrect fueling, improper charging, or unauthorized repair occurred.
  • Professional inspection, repair, or diagnostic findings.

The Owner may be responsible for ordinary mechanical failure. The Renter may be responsible when reliable evidence shows that prohibited, negligent, or improper use caused or materially worsened the failure.

11. Accidents and Serious Incidents

A Renter must report an accident, collision, rollover, fire, flooding, theft, vandalism, serious malfunction, injury, police contact, or other material incident as soon as reasonably possible.

  1. Address immediate safety and contact emergency services when necessary.
  2. Stop using the property when continued use may be unsafe or worsen the loss.
  3. Secure the property when reasonably possible.
  4. Notify the Owner through MyRentable.
  5. Photograph the property, surroundings, and relevant conditions.
  6. Obtain names, contact details, insurance information, witness information, and official report numbers when appropriate.
  7. Do not admit legal liability or promise payment on behalf of MyRentable.
  8. Follow reasonable recovery, return, inspection, and preservation instructions.

12. Theft, Disappearance, and Nonreturn

A Renter must return rented property and all included components at the agreed time and location.

When property is stolen, missing, abandoned, or not returned, the Renter must cooperate with reasonable recovery and investigation steps.

  • Provide the last known location and possession information.
  • Provide information about every person who accessed or used the property.
  • File a police report when reasonably requested or legally appropriate.
  • Provide keys, access information, tracking information, photographs, and relevant communications.
  • Cooperate with the Owner, MyRentable, an insurer, law enforcement, recovery providers, or payment providers.
  • Do not conceal, transfer, sell, pledge, disable tracking, or interfere with recovery.

A police report does not by itself establish or eliminate responsibility, but failure to report a credible theft may affect the Claim review.

13. Missing Components and Accessories

A Claim for missing property should identify each item and show that it was included when possession transferred.

  • Keys and access devices.
  • Chargers, cables, batteries, and power supplies.
  • Controls, remotes, tools, and adapters.
  • Attachments, accessories, guards, covers, and safety devices.
  • Manuals, cases, bags, containers, and storage components.
  • Replaceable parts or consumables only when the Listing required their return.

The eligible amount is generally limited to the reasonable cost of replacing the missing item with a comparable item, accounting for age, condition, depreciation, availability, and compatibility.

14. Cleaning Claims

Routine cleaning associated with normal rental turnover is an Owner responsibility unless clearly and lawfully disclosed otherwise.

A Claim may include reasonable Excessive Cleaning costs when the returned condition materially exceeds normal use.

  • Hazardous or prohibited substances.
  • Smoke, odor, bodily fluids, human or animal waste.
  • Paint, concrete, adhesive, chemicals, grease, oil, or contamination inconsistent with permitted use.
  • Excessive mud, debris, garbage, or residue beyond ordinary rental use.
  • Animal hair, infestation, or damage when animals were prohibited.
  • Cleaning required because the Renter ignored disclosed return instructions.

An Excessive Cleaning Claim must include photographs and reasonable evidence of the labor, materials, professional service, disposal, or remediation cost requested.

15. Late Return and Recovery Costs

Late-return amounts are not automatically Damage, but a Claim may include supported costs directly caused by an unauthorized late return.

  • A disclosed and reasonable late-return charge.
  • Reasonable recovery, towing, transport, or storage costs.
  • A supported refund or loss from a directly affected subsequent Booking.
  • Reasonable additional labor required to recover or inspect the property.
  • Other direct costs that were foreseeable, documented, and not avoidable through reasonable mitigation.

Speculative business loss, general inconvenience, unsupported lost opportunities, and remote consequential losses are generally not eligible.

16. Claim Submission Deadline

An Owner should inspect the property promptly after return and submit a Claim as soon as reasonably possible.

MyRentable may accept a later Claim when:

  • The Damage was concealed or could not reasonably have been discovered during the initial inspection.
  • The property was stolen, missing, retained, or inaccessible.
  • A serious mechanical or internal condition required professional diagnosis.
  • An emergency, hospitalization, law-enforcement process, or comparable circumstance prevented timely submission.
  • Applicable law, insurance requirements, or another written policy provides a longer period.

A delay may reduce or defeat a Claim when it prevents reliable investigation, allows additional Damage, or makes it impossible to connect the loss to the Booking.

17. Initial Claim Requirements

The Owner should submit the Claim through the applicable MyRentable Booking or Damage Claim workflow.

  • The affected Booking and property.
  • A clear description of what happened.
  • The date and approximate time the Damage or Loss was discovered.
  • Pre-rental and post-rental photographs or video.
  • The amount requested and how it was calculated.
  • Relevant messages and incident details.
  • Available repair estimates, receipts, invoices, value evidence, or replacement information.
  • Police, fire, insurance, towing, recovery, or incident reports when applicable.

MyRentable may permit supporting documents to be added after initial submission, but the Owner should not delay the initial Claim solely because every estimate or invoice is not yet available.

18. Acceptable Evidence

MyRentable may consider any reliable evidence reasonably related to the Claim.

  • Listing photographs and descriptions.
  • Pre-rental and post-rental photographs or video.
  • Photograph and video metadata.
  • Platform messages and support communications.
  • Pickup, delivery, return, mileage, hour, location, or access records.
  • Repair estimates, invoices, receipts, and diagnostic reports.
  • Purchase records and evidence of age or value.
  • Manufacturer specifications and repair procedures.
  • Police, fire, incident, insurance, towing, storage, or recovery reports.
  • Witness statements and contact information.
  • Admissions, explanations, or other statements from the Owner or Renter.
  • Prior maintenance, repair, Listing, Booking, and Claim records.

No single type of evidence automatically controls every Claim. MyRentable may evaluate reliability, timing, consistency, completeness, authenticity, and relevance.

19. Evidence Integrity

Users must submit authentic, accurate, and complete evidence.

  • Do not alter photographs, video, messages, metadata, timestamps, receipts, invoices, estimates, or reports.
  • Do not submit evidence from unrelated property or another incident.
  • Do not conceal material pre-existing conditions or prior repairs.
  • Do not coordinate false statements with another person.
  • Do not exaggerate the extent, cause, value, or repair cost of a loss.
  • Do not submit the same expense to MyRentable, an insurer, a payment provider, or another party without disclosing other recovery.

Fraudulent or misleading evidence may result in Claim denial, payment recovery, suspension, termination, or referral to an appropriate authority.

20. Preservation of Property and Evidence

The Owner should preserve the damaged property and relevant evidence while the Claim is under review when reasonably possible.

  • Do not dispose of a damaged item before documenting it adequately.
  • Do not begin nonemergency repairs before taking clear photographs and preserving replaced components when reasonable.
  • Retain invoices, estimates, diagnostic reports, parts, and proof of payment.
  • Take reasonable action to prevent additional Damage.
  • Notify MyRentable when immediate repair, disposal, cleanup, or recovery is necessary for safety or to prevent further loss.

MyRentable will not require unsafe storage or unreasonable delay of emergency repairs.

21. Owner Duty to Limit Additional Loss

An Owner must take reasonable steps to prevent avoidable additional loss after discovering Damage.

  • Secure the property from additional theft or weather exposure.
  • Stop operation when continued use could worsen the condition.
  • Arrange reasonable towing, storage, drying, cleanup, or emergency repair.
  • Avoid unnecessary premium, expedited, or emergency charges when ordinary service is reasonably available.
  • Preserve salvageable property and components.
  • Avoid unnecessary rental downtime.

MyRentable may reduce amounts that could reasonably have been avoided.

22. Renter Notice and Response

MyRentable may notify the Renter after a Claim is submitted and provide a reasonable opportunity to respond.

The Renter should:

  • Review the Claim promptly.
  • Provide an accurate description of the property's use, condition, incident, and return.
  • Submit pickup, use, incident, and return photographs or video.
  • Identify pre-existing conditions or prior disclosures.
  • Provide witness, police, insurance, repair, towing, or other relevant information.
  • Identify disputed amounts and explain the reason for each dispute.
  • Preserve relevant messages, documents, and evidence.

Failure to respond does not automatically prove responsibility, but MyRentable may decide the Claim from the available evidence.

23. Repair Versus Replacement

A repairable item generally should not be treated as a total loss when a safe, reasonable, and economically practical repair is available.

MyRentable may consider replacement when:

  • The property is stolen or cannot be recovered.
  • The property is destroyed or unsafe to repair.
  • The reasonable repair cost approaches or exceeds the property's pre-loss value.
  • Required components are unavailable.
  • A qualified provider determines that repair cannot restore safe and reliable function.
  • Applicable law, manufacturer requirements, or an insurer requires replacement.

An Owner may choose a more expensive repair or replacement, but the Claim remains limited to the supported eligible amount.

24. Repair Costs

Eligible repair costs may include reasonable amounts necessary to restore the property substantially to its pre-rental condition.

  • Replacement parts and ordinary shipping.
  • Reasonable professional labor.
  • Required diagnostic or inspection charges.
  • Reasonable towing, transport, or service-call charges.
  • Required taxes and disposal charges.
  • Reasonable cleaning or remediation directly related to eligible Damage.

MyRentable may request more than one estimate for a large, unusual, disputed, or potentially total-loss Claim.

A self-repair Claim may include documented parts and reasonable labor, but unsupported labor rates, estimated time, overhead, lost profit, or markup may be reduced or denied.

25. Replacement Value and Depreciation

When replacement is appropriate, the eligible amount is generally based on a comparable replacement rather than a new upgraded item.

MyRentable may consider:

  • Original purchase price and date.
  • Current age and condition.
  • Prior damage, repairs, and maintenance.
  • Expected useful life.
  • Current used-market value.
  • Availability and price of comparable property.
  • Functional and technological obsolescence.
  • Salvage, resale, or parts value.
  • Manufacturer support and component availability.

A Claim generally will not award the full cost of a brand-new upgraded item when the damaged property was older, used, worn, previously repaired, or less valuable.

26. Betterment and Upgrades

A Claim may be reduced when a repair or replacement materially improves the property beyond its pre-rental condition.

  • Replacing multiple undamaged components as part of an elective upgrade.
  • Installing a higher-capacity, premium, or newer model when a comparable replacement is available.
  • Including preventive maintenance or unrelated repairs.
  • Replacing worn components that had nearly reached the end of useful life.
  • Improving appearance, performance, efficiency, or resale value beyond restoration.

27. Loss of Use and Lost Bookings

Loss-of-use amounts are not automatically included in a Damage Claim.

MyRentable may consider a direct, documented loss from an affected confirmed Booking when:

  • Eligible Damage caused the property to be unavailable.
  • The affected Booking was confirmed before the Damage occurred.
  • The Owner could not reasonably provide substitute property.
  • The Owner took reasonable steps to repair or replace the property promptly.
  • The amount was not recovered through another source.

Speculative future income, general marketplace opportunity, reputational loss, business interruption, and unconfirmed reservations are generally not eligible.

28. Amounts Generally Not Eligible

  • Ordinary Wear and Tear.
  • Pre-Existing Damage not worsened by the Renter.
  • Routine maintenance or normal turnover cleaning.
  • Betterment, upgrades, or unrelated repairs.
  • Unsupported labor, markup, overhead, inconvenience, or administrative time.
  • Speculative lost profits or unconfirmed future rentals.
  • Punitive, exemplary, or emotional-distress amounts.
  • Amounts already recovered through insurance, another User, a payment provider, warranty, manufacturer, repairer, or third party.
  • Avoidable additional Damage caused by unreasonable delay or inadequate mitigation.
  • Property prohibited by MyRentable or unlawfully listed.
  • Loss resulting from inaccurate Owner instructions, inadequate maintenance, or undisclosed defects.
  • Amounts prohibited by law or inconsistent with applicable insurance or protection terms.

29. Security Deposits

A Security Deposit may be used toward an approved Claim, but the Deposit does not determine the final amount of responsibility.

The approved amount may be:

  • Less than the Security Deposit.
  • Equal to the Security Deposit.
  • Greater than the Security Deposit when permitted by law and supported by the evidence.
  • Zero when the Claim is denied.

Any unused Deposit amount or authorization will be released or refunded according to the payment method, processor timing, and unresolved obligations.

30. Optional Protection and Insurance

MyRentable is not an insurer unless expressly stated in a separate written coverage document identifying a licensed insurance provider.

Until such third-party insurance is expressly offered, an optional MyRentable protection plan is a platform benefit and not an insurance policy. It may reduce a Renter's financial responsibility only for eligible accidental Damage approved after individual review. Purchase does not guarantee approval, payment, or reimbursement.

Optional protection requests remain subject to requirements that may include:

  • Eligibility requirements and applicable plan limits.
  • Excluded property, conduct, losses, or uses.
  • Reporting and documentation deadlines.
  • Required cooperation and truthful information.
  • Evidence of the condition, cause, and amount of the claimed Damage.
  • Recovery from responsible parties or other available sources.

Protection generally does not apply to intentional Damage, misuse, illegal activity, unauthorized users, normal wear and tear, mechanical failure, manufacturer defects, pre-existing Damage, operation while impaired, undocumented theft or loss, or a material violation of the Rental Agreement or MyRentable policies.

A MyRentable Claim decision does not determine every legal right or liability and does not guarantee payment from an insurer or another third party.

31. Other Sources of Recovery

Users must disclose payment or reimbursement received or expected from another source for the same loss.

  • Personal or commercial insurance.
  • Credit-card or payment-method protection.
  • Manufacturer, dealer, repairer, or warranty coverage.
  • A third party responsible for the Damage.
  • Police recovery, restitution, salvage, or resale.
  • Another marketplace, protection plan, or reimbursement program.

A User may not receive more than the supported loss through duplicate recovery.

32. MyRentable Claim Review

MyRentable may review the Claim, request additional information, compare evidence, and communicate with the Owner and Renter.

MyRentable may also consult or share relevant information with:

  • Payment processors.
  • Insurance and protection providers.
  • Repair, diagnostic, appraisal, recovery, towing, or storage providers.
  • Manufacturers or authorized service providers.
  • Law enforcement, courts, regulators, or government agencies.
  • Professional advisers and fraud-prevention providers.

Any consultation does not make MyRentable the owner, repairer, appraiser, or insurer of the property.

33. Factors Considered

  • The Listing and Booking terms.
  • The property's pre-rental and post-rental condition.
  • The nature, location, severity, and timing of the Damage.
  • The disclosed and actual use of the property.
  • The Owner's maintenance and disclosure history.
  • The Renter's conduct, instructions received, and incident response.
  • Photographs, video, messages, reports, diagnostics, estimates, and invoices.
  • Age, condition, value, depreciation, useful life, and salvage value.
  • Repair feasibility and comparable replacement options.
  • Whether either User delayed reporting, concealed information, altered evidence, or failed to mitigate loss.
  • Prior claims, reports, warnings, or policy violations.
  • Applicable law, payment rules, and insurance or protection requirements.

34. Claim Statuses

A Claim may move through one or more platform statuses, including:

Submitted
The Claim has been received and awaits initial review.
Needs More Information
Additional evidence or explanation is required.
Under Review
MyRentable is reviewing the available information.
Waiting on Owner
The Owner must respond or provide requested information.
Waiting on Renter
The Renter must respond or provide requested information.
Waiting on Insurance
A related insurer or protection provider process remains pending.
Approved
The full eligible amount determined by MyRentable has been approved.
Partially Approved
Only part of the requested amount has been approved.
Denied
The available evidence or Policy does not support payment.
Resolved
The Claim has reached a completed resolution.
Closed
The Claim was withdrawn, abandoned, duplicated, ineligible, or otherwise concluded without further review.

35. Claim Decisions

MyRentable may:

  • Approve the requested amount.
  • Approve a reduced amount.
  • Deny the Claim.
  • Request additional evidence.
  • Close a duplicate, abandoned, fraudulent, or ineligible Claim.
  • Apply an approved amount against a Security Deposit or payment authorization.
  • Collect an approved amount through the payment method or Account balance.
  • Offset an approved amount against an eligible payout or credit.
  • Refer the matter to an insurer, payment provider, recovery provider, law enforcement, or other appropriate party.
  • Facilitate a voluntary settlement between the Owner and Renter.

A Claim decision does not necessarily determine criminal responsibility, negligence under all applicable law, insurance coverage, or liability to third parties.

36. Authorization to Collect Approved Amounts

Subject to the Terms of Service, payment authorization, applicable law, and the final Claim decision, MyRentable and its payment processors may collect an approved amount from:

  • A Security Deposit.
  • A previously authorized payment method.
  • An Account balance or marketplace credit.
  • A payout otherwise payable to the responsible User.
  • Another payment method voluntarily provided for the Claim.

MyRentable may use lawful collection or recovery methods for an unpaid approved amount.

A failed payment does not eliminate the underlying obligation.

37. Payment to the Owner

An approved Claim does not guarantee immediate Owner payment.

Payment may depend on:

  • Successful collection from the responsible User.
  • Security Deposit availability.
  • Payment-provider processing.
  • Insurance or protection-provider approval.
  • Fraud, chargeback, legal, or compliance review.
  • Required Owner identity, tax, or payout verification.
  • Any deductible, limit, exclusion, offset, or prior recovery.

MyRentable may pay an approved amount before collecting it only when expressly supported by a separate protection or insurance arrangement.

38. Owner and Renter Settlements

The Owner and Renter may propose a voluntary settlement through MyRentable.

A settlement should identify:

  • The agreed amount.
  • The payment method.
  • Whether the agreement fully or partially resolves the Claim.
  • Any repair, return, replacement, or other required action.
  • Any remaining unresolved issue.

MyRentable may decline to process an agreement involving fraud, unlawful terms, off-platform circumvention, payment manipulation, or harm to another party.

39. Chargebacks and Payment Disputes

A chargeback or payment dispute does not automatically reverse a Claim decision or eliminate a valid obligation.

MyRentable may provide relevant records to the payment provider, including:

  • Terms and Policy acceptance records.
  • Listing and Booking information.
  • Messages and notifications.
  • Claim submissions and responses.
  • Photographs, estimates, invoices, and decision records.
  • Security Deposit and payment authorization information.
  • Refunds, credits, payments, or settlements already provided.

An improper or fraudulent chargeback may result in a negative balance, collection activity, payout holds, payment restrictions, suspension, or termination.

40. Claim Appeals

An Owner or Renter may request additional review of an eligible Claim decision.

An appeal should:

  • Identify the affected Claim and decision.
  • Explain the specific part of the decision believed to be incorrect.
  • Provide new, corrected, or previously unavailable material evidence.
  • Be submitted within fourteen calendar days after notice of the decision unless another period is stated.

An appeal is not a complete restart of the Claim and does not guarantee a different result.

MyRentable may uphold, modify, reverse, reopen, or return the Claim for additional review.

Repeated appeals without new material information may be closed.

41. Claim Fraud and Abuse

Users may not misuse the Damage Claim process.

  • Submitting Damage that existed before the Booking.
  • Inflating repair, replacement, cleaning, towing, storage, or recovery costs.
  • Seeking payment for Ordinary Wear and Tear or routine maintenance.
  • Creating or altering photographs, video, receipts, invoices, estimates, or reports.
  • Coordinating false evidence or statements.
  • Damaging property intentionally to create a Claim.
  • Concealing insurance, warranty, salvage, restitution, or other recovery.
  • Submitting duplicate recovery requests for the same loss.
  • Using a Claim to harass, threaten, retaliate, or obtain an unrelated benefit.

Fraud or abuse may result in denial, reversal, repayment obligations, payout holds, collection, suspension, termination, or referral to an appropriate authority.

42. Law Enforcement and Legal Proceedings

Users should contact law enforcement when property is stolen, intentionally damaged, unlawfully retained, involved in a serious accident, or connected to suspected criminal conduct.

MyRentable may preserve and disclose relevant information in response to valid legal process, qualifying emergency requests, or applicable law.

A User's decision not to file a police report does not automatically defeat every Claim, but a report may be required when reasonably necessary to investigate theft, fraud, vandalism, or serious loss.

43. Rights Outside MyRentable

A User may have rights or obligations outside the MyRentable Claim process.

  • Insurance claims.
  • Warranty or manufacturer remedies.
  • Claims against a repairer, transporter, or other third party.
  • Police reports or criminal restitution.
  • Consumer-protection complaints.
  • Small-claims or other court proceedings.
  • Rights under applicable contract, property, negligence, or other law.

Nothing in this Policy prevents a User from contacting an attorney, insurer, law-enforcement agency, regulator, consumer-protection agency, or court.

MyRentable does not provide legal, repair, appraisal, accounting, tax, or insurance advice.

44. Nonwaivable Legal Rights

This Policy applies only to the extent permitted by law.

Nothing in this Policy eliminates a warranty, remedy, consumer protection, reporting right, or other legal protection that cannot lawfully be waived.

When applicable law provides greater protection, the legally required protection will apply.

45. Changes to This Policy

MyRentable may update this Policy to reflect changes in law, payment systems, insurance products, marketplace features, Claim procedures, or risk controls.

The current version, effective date, and last-updated date will appear in the Legal Center.

The Policy in effect at the time of the relevant Damage or Loss generally governs the Claim unless applicable law, a separate coverage agreement, or the updated Policy expressly requires otherwise.

46. Questions and Support

Damage Claims should be submitted through the applicable Booking workflow. General questions may be sent to support@myrentable.com.

A support request should identify the Booking and Claim involved and include enough information to understand the requested assistance.

For immediate threats, theft in progress, serious injury, fire, or another emergency, contact emergency services before contacting MyRentable.
