MyRentable Copyright and Intellectual Property Policy

This Policy explains user intellectual-property responsibilities, copyright and trademark complaints, DMCA notices, counter-notices, repeat infringement, content removal, and restoration procedures.

1. Purpose and Scope

This Copyright and Intellectual Property Policy explains how MyRentable, LLC handles intellectual-property concerns involving Listings, photographs, descriptions, reviews, profile information, messages, documents, logos, trademarks, software, and other content submitted to or displayed through MyRentable.

This Policy applies to Owners, Renters, visitors, rights holders, authorized representatives, and other people who submit, display, access, or report content through MyRentable.

This Policy supplements the Terms of Service, Community Standards, Privacy Policy, Prohibited Items Policy, and applicable law.

2. User Responsibility for Content

Users are responsible for ensuring that content they submit or use through MyRentable is lawful and does not violate another person's rights.

  • Use photographs and video that the User created or is authorized to use.
  • Use Listing descriptions, manuals, specifications, and documents lawfully.
  • Do not copy another Owner's Listing without permission.
  • Do not use another person's logo, trademark, trade name, or branding in a misleading manner.
  • Do not upload counterfeit, pirated, unlawfully copied, or unauthorized material.
  • Do not submit private, confidential, or proprietary material without authorization.
  • Do not falsely claim ownership, licensing, affiliation, sponsorship, certification, or endorsement.

3. License Granted to MyRentable

Users retain ownership of content they create, subject to the license granted in the Terms of Service.

By submitting content, the User grants MyRentable the rights reasonably necessary to:

  • Host, store, reproduce, format, resize, and display the content.
  • Publish the content through Listings, profiles, reviews, messages, and transaction workflows.
  • Distribute the content through supported marketplace and communication features.
  • Use the content for fraud prevention, safety, support, moderation, claims, and dispute review.
  • Create technical copies, thumbnails, previews, backups, and archival records.
  • Promote the Listing or marketplace when permitted by the Terms and Privacy Policy.

The license does not transfer ownership of the User's content to MyRentable.

4. MyRentable Intellectual Property

MyRentable and its licensors own the platform software, source code, design, databases, branding, logos, trademarks, visual elements, documentation, and other proprietary material, excluding User Content.

  • Users may not copy, reproduce, distribute, sell, sublicense, or commercially exploit MyRentable technology or branding without authorization.
  • Users may not use MyRentable marks in a manner suggesting false affiliation, sponsorship, certification, or endorsement.
  • Users may not register domains, social-media names, business names, or trademarks confusingly similar to MyRentable marks.
  • Users may not remove copyright, trademark, attribution, or ownership notices from MyRentable materials.

5. Prohibited Intellectual-Property Content

  • Counterfeit goods or unauthorized replicas presented as genuine.
  • Pirated software, films, music, books, photographs, games, manuals, or digital content.
  • Listings copied from another marketplace or Owner without authorization.
  • Unauthorized manufacturer, retailer, distributor, or certification logos.
  • Altered branding intended to conceal the origin of property.
  • Content containing unlawfully copied plans, drawings, schematics, or technical documents.
  • Devices or software offered primarily to defeat copyright-protection systems unlawfully.
  • Content violating rights of publicity, privacy, trade secret, or confidential information.

7. DMCA Designated Agent

Until the registered agent information is added, copyright-related questions may be directed to support@myrentable.com. This temporary contact statement does not replace the federal designated-agent registration requirement.

8. Required DMCA Notice Information

A copyright-infringement notice intended to comply with the DMCA must be a written communication provided to MyRentable's registered designated agent and should include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list when multiple works are involved.
  3. Identification of the allegedly infringing material and information reasonably sufficient to allow MyRentable to locate it.
  4. The complaining party's name, mailing address, telephone number, and email address.
  5. A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

9. Information Needed to Locate Content

A notice should identify the disputed content with enough specificity for MyRentable to locate it reliably.

  • The complete Listing or profile URL.
  • The Listing title and identifying information.
  • The Account or display name associated with the content.
  • A description of the specific photograph, text, logo, video, or document involved.
  • Screenshots showing the reported material.
  • The Booking, review, message, or other relevant platform location.

A broad request to remove an entire Account, category, or search result without identifying specific infringing material may be insufficient.

10. Incomplete or Defective Notices

MyRentable may request additional information when a notice is incomplete, unclear, unsigned, unverifiable, or does not identify the disputed material adequately.

MyRentable may be unable to act on a notice that does not provide the information required by applicable law.

MyRentable may still take discretionary action when content presents an independent policy, fraud, safety, counterfeit, or legal concern.

11. Review of Copyright Notices

After receiving a qualifying notice, MyRentable may:

  • Remove or disable access to the identified material.
  • Temporarily restrict the affected Listing or Account.
  • Notify the User who submitted the content.
  • Provide the User with a copy or summary of the notice.
  • Request additional information from the complaining party or affected User.
  • Preserve relevant records.
  • Take no action when the notice is legally insufficient or clearly unrelated to copyright.

Removal or restriction does not necessarily constitute a final determination that infringement occurred.

12. DMCA Counter-Notice

A User whose material was removed or disabled in response to a DMCA notice may submit a counter-notice when the User believes the removal resulted from mistake or misidentification.

A counter-notice intended to comply with the DMCA must be a written communication provided to MyRentable's registered designated agent and should include:

  1. The User's physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that the User has a good-faith belief that the material was removed or disabled because of mistake or misidentification.
  4. The User's name, address, and telephone number.
  5. A statement consenting to the jurisdiction of the appropriate United States federal district court and agreeing to accept service of process from the person who submitted the original notice or that person's agent.

13. Disclosure of a Counter-Notice

MyRentable may provide a valid counter-notice to the person who submitted the original copyright notice.

By submitting a counter-notice, the User understands that the User's name, address, telephone number, statements, and other legally required information may be disclosed to the complaining party.

A User concerned about disclosing personal information should consult qualified legal counsel before submitting a counter-notice.

14. Possible Restoration of Content

After receiving a legally sufficient counter-notice, MyRentable may restore the material within the period permitted by federal law unless the original complaining party notifies MyRentable that a court action has been filed seeking to restrain the User's allegedly infringing activity.

MyRentable may decline to restore material when:

  • The material independently violates another MyRentable policy.
  • The Listing or Account is restricted for fraud, safety, counterfeit, or legal reasons.
  • The material is no longer relevant or the User removed it voluntarily.
  • A court order or other legal restriction prevents restoration.
  • MyRentable cannot technically restore the prior content.

15. False or Misleading Notices

A person must not knowingly and materially misrepresent that content is infringing or that content was removed through mistake or misidentification.

  • Do not submit a notice concerning content the sender does not own or represent.
  • Do not use copyright procedures to suppress criticism, competition, reviews, price comparisons, or lawful use.
  • Do not omit known licensing or authorization information intentionally.
  • Do not submit forged signatures, false contact information, or fabricated ownership records.
  • Do not submit a counter-notice when the User knows the material was unauthorized.

False or abusive submissions may result in Account restrictions, refusal to process future submissions, preservation of evidence, legal liability, or referral to appropriate authorities.

16. Repeat Infringer Policy

MyRentable may suspend or terminate Users who repeatedly infringe copyrights or other intellectual-property rights in appropriate circumstances.

MyRentable may consider:

  • The number and frequency of qualifying complaints.
  • Whether multiple complaints involve distinct works or rights holders.
  • Whether content was restored after a valid counter-notice.
  • Whether a court or other authority determined that infringement occurred.
  • Whether the User knowingly submitted counterfeit or pirated property.
  • The User's history of warnings, removals, and policy violations.
  • The credibility and completeness of the available evidence.
  • Whether the User attempted to evade enforcement through additional Accounts.

MyRentable is not required to wait for a pattern of repeated violations before acting on serious, intentional, fraudulent, or clearly unlawful infringement.

17. Trademark Complaints

Trademark owners or authorized representatives may report content believed to misuse a trademark, trade name, logo, certification mark, or other source identifier.

A trademark complaint should include:

  • The complainant's name and contact information.
  • Identification of the trademark owner.
  • The mark involved and any registration information.
  • The jurisdiction and registration number, when applicable.
  • The specific Listing, Account, photograph, or content involved.
  • An explanation of how the use is allegedly infringing, counterfeit, or misleading.
  • A statement that the information provided is accurate and the complainant is authorized to act.
  • A physical or electronic signature.

18. Review of Trademark Complaints

MyRentable may consider whether the reported use:

  • Identifies the actual manufacturer or brand of listed property accurately.
  • Falsely suggests affiliation, sponsorship, authorization, or certification.
  • Offers counterfeit or unauthorized branded property.
  • Uses a mark descriptively, comparatively, editorially, or for another potentially lawful purpose.
  • Creates a material likelihood of confusion about the source of the Listing or property.
  • Violates another MyRentable policy independently.

MyRentable may request additional evidence or decline to resolve a complex trademark dispute that requires a court or other competent authority.

19. Counterfeit Property

Counterfeit property and unauthorized replicas presented as genuine are prohibited.

  • Owners must describe the actual manufacturer and model accurately.
  • Owners must not alter photographs or labels to conceal origin.
  • Owners must not use another company's branding on unauthorized property.
  • Owners must not claim that property is certified, licensed, approved, or genuine without support.
  • Owners must cooperate with reasonable authenticity and ownership requests.

MyRentable may remove suspected counterfeit property without waiting for a formal DMCA notice because counterfeit concerns may involve trademark, fraud, safety, and prohibited-item rules.

20. Patent, Design, and Other Rights

Complaints involving patents, trade dress, industrial designs, trade secrets, confidential information, or other complex rights should identify the applicable right and provide reliable supporting documentation.

MyRentable may request a court order, legal judgment, settlement, or other authoritative evidence before taking action on a complex dispute.

MyRentable may still restrict content when it independently violates marketplace policies or creates substantial legal, safety, or fraud risk.

21. Publicity, Likeness, and Privacy Rights

Users may not submit photographs, video, names, likenesses, voices, signatures, private documents, or personal information in violation of another person's rights.

  • Do not use another person's image to suggest endorsement without permission.
  • Do not post identification documents, private addresses, financial information, or private communications improperly.
  • Do not upload intimate or nonconsensual images.
  • Do not secretly record a person where notice or consent is legally required.
  • Do not use a person's name, photograph, or likeness for deceptive commercial purposes.

Privacy and safety concerns may also be governed by the Privacy Policy and Community Standards.

22. Listing Photographs

Listing photographs should show the actual property being offered and should be created or lawfully used by the Owner.

  • Manufacturer stock photographs may be used only when authorized and not misleading.
  • A stock photograph must not conceal material differences in model, condition, accessories, or appearance.
  • Photographs copied from another Owner, retailer, marketplace, or website require permission or another lawful basis.
  • Watermarks and ownership notices may not be removed without authorization.
  • Images generated or materially altered by software must not misrepresent the actual property.

23. Listing Descriptions and Specifications

Owners may use factual product names, model numbers, dimensions, compatibility information, and ordinary descriptive information when lawful and accurate.

Users may not copy substantial protected descriptions, manuals, marketing copy, reviews, or database content without authorization.

Quoting limited material does not automatically make the use lawful. Users are responsible for evaluating licensing, attribution, fair use, and other requirements.

24. Manuals, Software, and Digital Material

An Owner may provide manuals, software, firmware, access credentials, or digital files only when authorized and necessary for lawful use of the rented property.

  • Do not distribute pirated software or unauthorized license keys.
  • Do not share subscription Accounts or software licenses in violation of their terms.
  • Do not bypass activation, digital-rights-management, or access controls unlawfully.
  • Do not upload confidential service manuals, trade secrets, or restricted technical data without authorization.
  • Remove personal and confidential information from devices before rental when appropriate.

25. Reviews and Intellectual Property

Users may describe genuine experiences and may refer to brands, models, or businesses when relevant.

Reviews may not include unlawfully copied photographs, private documents, counterfeit branding, or substantial copyrighted material unrelated to the review.

MyRentable will not remove truthful criticism merely because a business or User dislikes it, but content may be restricted when it violates law or another policy.

26. Reporting Other Intellectual-Property Concerns

A report involving a right other than copyright should include enough information for MyRentable to understand and evaluate the concern.

  • The reporting person's identity and contact information.
  • The rights holder and the reporting person's authority.
  • A description of the right involved.
  • Registration, ownership, licensing, or authorization records when applicable.
  • The exact MyRentable content being reported.
  • An explanation of the alleged violation.
  • Relevant court orders, judgments, correspondence, or other evidence.
  • A statement that the report is accurate and submitted in good faith.

27. Enforcement Actions

MyRentable may take action reasonably necessary to address intellectual-property concerns.

  • Remove or disable content.
  • Restrict or deactivate a Listing.
  • Cancel or prevent a Booking involving counterfeit or prohibited property.
  • Request proof of ownership, licensing, authenticity, or permission.
  • Issue a warning.
  • Restrict content-upload or marketplace features.
  • Temporarily suspend an Account.
  • Permanently terminate an Account.
  • Preserve evidence and transaction records.
  • Comply with court orders and valid legal process.

28. Effect on Bookings, Refunds, and Payouts

An intellectual-property complaint may affect a Listing, Booking, refund, payment, Damage Claim, or Owner payout when the reported content or property is material to the transaction.

  • A Booking may be cancelled when the listed property is counterfeit, pirated, unlawfully licensed, or materially misrepresented.
  • An innocent Renter may be eligible for a refund under applicable policies.
  • An Owner may lose eligibility for earnings from a prohibited or fraudulent Listing.
  • Payments and payouts may be held while authenticity, ownership, fraud, or legal issues are reviewed.
  • MyRentable may recover refunds, chargebacks, or other losses caused by a User's violation.

29. Disclosure of Complaints

MyRentable may provide a complaint, notice, counter-notice, or relevant identifying information to:

  • The User who submitted the reported content.
  • The complaining party or rights holder.
  • Legal counsel and professional advisers.
  • Payment processors, insurers, or service providers when relevant.
  • Courts, law-enforcement agencies, regulators, or government authorities.
  • Other parties when required by law or reasonably necessary to resolve the matter.

Personal information will be handled according to the Privacy Policy and applicable law.

32. Appeals and Additional Review

A User may request review of an eligible non-DMCA intellectual-property enforcement decision.

The request should:

  • Identify the affected Listing, content, Account, or decision.
  • Explain why the User has the right to use the material.
  • Include licenses, permissions, ownership records, purchase records, or other relevant evidence.
  • Address the specific complaint or policy concern.
  • Be submitted within the period stated in the decision notice.

Formal DMCA removals should be challenged through the statutory counter-notice procedure when applicable.

33. Abuse of Intellectual-Property Procedures

Users and complainants may not misuse this Policy to harass, retaliate, suppress competition, interfere with lawful Listings, or obtain confidential information improperly.

  • Submitting notices without a good-faith rights claim.
  • Claiming ownership of public-domain or independently created material knowingly.
  • Submitting repetitive complaints after receiving clear contrary evidence.
  • Using complaints to pressure another person for money or unrelated benefits.
  • Creating false documents, licenses, registrations, signatures, or authorization records.
  • Evading enforcement through duplicate Accounts or repeated reuploads.

34. Changes to This Policy

MyRentable may update this Policy to reflect changes in intellectual-property law, platform features, content types, reporting procedures, court decisions, or marketplace risks.

The current version, effective date, and last-updated date will appear in the Legal Center.

MyRentable may update the designated-agent contact information without changing the substantive rights and obligations described in this Policy.

A valid DMCA notice or counter-notice should be sent to the registered designated agent rather than through a general customer-support workflow.
